Terms and Conditions of Business Trading 2024 for Aquascape Fish Imports Ltd.

Orders - Orders must be received by 5pm on the day prior to delivery. (Midday on the day of despatch for deliveries sent by overnight courier). All items are subject to stock availability and out of stock items may be substituted for a similar item unless otherwise requested not to. Generally all orders within 30 mile radius of Birmingham are delivered by our own drivers and outside of this area are sent by Defra approved overnight courier service. Please note there are set delivery days in certain areas and courier orders are despatched Tuesday - Thursday only.

Internet Online Orders - Orders can be placed over the internet via our online web site at www.aquascape.co.uk but please call to confirm we have received your order. We have a 24 hour online ordering system with pictures of all our products at www.aquascape/co.uk/orderonline To download a copy of this month’s availability stock list containing all these fish and a list of everything we sell click here www.aquascape.co.uk/lists All pictures are for illustration purposes only and may not accurately depict the fish in question. All sizes are approximate and based on the supplier’s guide size therefore the sizes may vary

Prices - All orders are charged at the current price ruling on the day of despatch and are subject to V.A.T at the current rate. Please see our current weekly availability listings for the latest prices. A full VAT invoice clearly stating all items ordered, delivery dates and payment terms is included with every order.  All prices and offers are subject to change and availability. E&OE accepted. Cheques returned by the bank will be subjected to a £27.50 handling charge and interest may be charged on overdue accounts at the base rate until the account is settled in accordance with The Late Payment of Commercial Debts (Interest) Act 1998 . Payments must be settled within 48hours of a cheque being returned to ourselves. An outstanding account charge will be made on overdue / uncleared payments at the rate of 8% above the Bank of England Base Rate.

Sizes of Products - Please note that sizes are only approximate and may vary. Wherever possible sizes are listed in the catalogue and these sizes are based on our suppliers sizes. All sizes are approximate and based on the suppliers guide size therefore the sizes may vary

Claims or Shortages - Any claims for shortages or losses must be made on the day of arrival and if applicable to the delivery driver whilst inspecting your fish. Otherwise please report your losses and shortages by telephone or fax on day of arrival. Please provide a photograph of the dead fish in the unopened bags to validate your claim. Once the fish have been introduced into your systems we cannot take any responsibility as many factors can influence the health of the fish from this point onwards. Unfortunately no responsibility can be accepted for the loss of any fish or plants already established in your aquaria.

Deliveries & Delivery Charges - Most deliveries are made by our own van service. Please inspect your fishes upon arrival to you, report any losses etc to the driver and return the polystyrene boxes with them. A same day or overnight courier service may also be used to send some deliveries. When such circumstances arise please keep all polystyrene boxes and these will be collected from you. All deliveries are free of charge providing they exceed £300.00 net value. Orders under £300.00 net value will be charged at the rate of £30 per order or courier charges at cost whichever is deemed applicable. All quoted delivery charges are subject to VAT at the current rate.

ALL OTHER AREAS DELIVERY BY OVERNIGHT COURIER (ORDERS NEEDED BY MIDDAY FOR NEXT WORKING DAY DELIVERY). COURIER ORDERS MINIMUM £300 EX VAT FOR FREE DELIVERY, ORDERS UNDER THAT VALUE ARE SUBJECT TO £30 EX VAT DELIVERY CHARGE

Payments - Payment can be made by cash, cheque or credit card. Credit cards accepted are Mastercard, Maestro, Visa, Visa Electron, Switch, Solo and JCB. Credit Accounts - Aquascape Fish Imports Ltd. retain legal ownership of all goods until paid for in full. Accounts are available to customers on receipt of satisfactory references, after initial orders that are suitably paid for and upon satisfactory completion of an account application form. Initial credit accounts

are offer on a 7day credit basis. Providing orders are received weekly and payments are made on time accounts will be increased to 28 days max.

Overdue Accounts - Accounts that are not settled within the agreed period will be subject to a £25.00 admin charge.  An overdue account charge will be made on overdue accounts at the rate of 8% above the National Westminster Bank base rate after suitable warning of overdue accounts has been made.

Polystyrene Boxes - Please retain all polystyrene boxes and return them with the driver if possible.  Polystyrene boxes need not be returned for orders despatched courier.
